Mary Kelly Re-trial Set For Feb

Next Hearing October 31st

The preliminary hearing for the re-trial of peace activist Mary Kelly took place at Kilrush circuit court yesterday. Judge Carl Moran, who presided over the original trial, which ended with a hung jury, set a date for early February, 2004.

The decision on the application to extend legal aid to cover witnesses was adjourned yesterday to come before Judge Moran on October 31st. Given the Judge denied Mary extended legal aid at the first trial, the defence team are not optimistic about the application.

This denial of financial aid, along with the refusal of the judge to accept expert testimony and the ruling of crucial video evidence as inadmissible, prompted the defence to seek a judicial review of the last case in the high court. This was refused last Friday.

It is absolutely crucial that Mary’s legal team have the finances to mount a proper defence and they therefore welcome any fundraising initiatives by supporters. An international defence fund is also being set up and more details on this will follow.

A good crowd of supporters and well wishers from Dublin, Co. Galway & Limerick were outside the court room yesterday along with the by now, truly rotten corpse of Irish Neutrality. Support is needed so nnyone who can make it to Kilrush for the 31st October, please do.

Great-looking presence in Kilrush – well done to all and good luck to Mary. Pity about the paper seller on the end – whats the bloody point. They obviously don't seriously expect to sell papers on pickets so is it some sort of statement? 'Look at me – Im in the SWP!' So?

....the Pilger video on the effect of the sanctions in Iraq, was due to be shown but the judge ruled it was 'too emotional & would affect the Jury'. No shit. For a good report on the original trial see related link.
