The cookie crumbles Marie Farell, a key witness in the placing of Ian Bailey at the bridge in Kealfadda, Goleen West Cork, the night of the murder of Sophie Toscan du Plantier has this evening come out with a truth that shows the entire Garda investigation was inept, corrupt and based on a fit-up and intimidation. She confessed on TV3 that she was fed a story by Gardai and made false statements at their command. She was in fear of her life of them she said. Her solicitor Frank Buttimer has been in contact with the solicitor of Ian Bailey about the disclosure and is calling for an investigation into the matter. |

Ms Toscan du Plantier’s family believes closer scrutiny of the garda files would highlight inconsistencies in witness statements. They are also interested in claims by the evidence of one local woman, Marie Farrell, that she saw Bailey a short distance from Ms Toscan du Plantier’s home, shortly she is believed to have been killed.
you did good work clearly and full credit for hanging in there....i was wondering would it be possible to publish the full statement that marie farrell is now making since i think it is now with bailey's solicitors?it might make interesting reading?
Marie Farrell, who testified during a libel action by Ian Bailey that she saw him at Kealfadda Bridge on the night Mme Du Plantier was murdered, now states that this, and other statements, were incorrect.
“The information she has furnished confirms any reference in any of the statements she made concerning Mr Bailey is certainly incorrect. She has withdrawn all allegations which she has heretofore made against Mr Bailey in any of the statements she has made.
Two more witnesses in the case have made statements to Frank Buttimer , according to the solicitor for Mr Bailey, but he will not go into details. They did so last week, one concerning the garda investigation and the other concerning the libel trial.
Commissioner Noel Conroy has appointed his assistant Ray McAndrew who investigated the Donegal scandal to head the investigation. He will have two chief superintendents and a superintendent from outside the West Cork area on his team and will begin in days.
Supt Liam Horgan of Bantry who has headed the investigation into the du Plantier murder says he welcomes the investigation into his investigation. Of course he does! As does West Cork GRA representative Pat O'Sullivan.
Of course in Donegal the Carthy investigation made no difference and it was only when a judicial tribunal was established that things were resolved. For now this is a welcome move but what can we expect as long as Gardai investigate Gardai?
Prepare for much more waiting and indeed much more shocking revelations.
A trial took place. Things came out. Two SC heard chatting shortly afterwards about how the murderer was a member of the Garda and that his was never going to come to light. Is this a rumour? I was told it was not. Don't know what to believe.
Watched the rte programme tonight.
Very flawed Gárda case, I thought.
Look at the culture that the organisation has tolerated in all those years since.
All their ' evidence is very circumstansial and convenient.
Who was the man on the bridge then and why no follow up of consequence.
An English man who had no family down there, our Irish proclivity to blame the outsider and talk behind backs and believe in conspiracy.
Could there have been a State conspiracy to cover up one of their own ?
This is a valid question with all that has come out about how the Gárda has been operating, some of them, not all or most.
The man has offered to go on trial. Is that possible ?
I watched the RTE programme last night presented by Phillip Boucher Hayes. I am unclear as to the purpose of the programmes but if it was meant to be a piece of investigative journalism with a view to catching Sophie's killer then it failed miserably. Mr. Boucher Hayes is no Michael Mansfield QC or George Carmen QC and so his approach of cross examining Mr. Bailey and his partner Miss. Thomas was nothing short of an embarassing and childish attempt to trip up Bailey and Thomas and make them look bad. Not one single shred of evidence, whether circumstantial or otherwise was presented to us that might implicate Bailey but even worse was the programmes deliberate omission of a lot of good circumstantial evidence that points to another good suspect. No attempt was made to look into this other suspect who fled the area shortly after the killing and his family omitted to tell Garda that he had been in the area the night of the killing.
Anyone with a little experience of criminal investigation would tell you that Sophie was killed by someone that she knew and that lived close by. He also had to know and be familiar with the layout of the area and grounds around the cottage and murder scene. A young man besotted by a sophisticated older lady and who, in drink or otherwise, plucked up the courage to go to her house nearby in the middle of the night only to be rebuffed and a tragedy follows. I have soent over 20 years dealing with serious criminal cases including murder cases and it is obvious to me that the killer was local, he knew the layout, he knew Sophie was present and lived alone. This was no random killing. This was a crime of passion (at least from the killers point) gone wrong. Time to stop this Bailey nonsence and get over to the UK and interview what should be the prime suspect.
The main point you make is that the RTE documentary summarized the main facts of the Toscan du Plantier murder, but added no new facts. You mention local gossip that " a young man besotted by a sophisticated older lady" was possibly the murderer. This is community rumour, not evidence. If members of the Schull community have any concrete facts that might lead to the murderer, they should go to the Gardai with them.
Would a perjury case, if it were persued by the DPP, not help to expose the plasticine nature of Marie Farrells original evidence and the shameful moulding of that evidence by her Garda handlers, and bring about a conviction of either her or the relevant Guards, or both of them for their vindictive hounding of “The black English bollix”, as the uncovered Bandon tapes revealed they referred to Ian Bailey .
Would it not also highlight who Marie Farrell did see by Kaelfadda Bridge that terrible night and whose company she was with. Maybe this would then uncover the truth to the extraordinary revelation by the contributor to this site “Hilall” of the overlooked suspect , “ a young man, a fluent French speaker who had been educated in private schools in France and Ireland and was staying with his family a short walk from the murder scene on the night of the murder”.
The DPP report(see link) exposed the flawed and unbelievable case of dodgy circumstantial evidence the Guards, for whatever reasons best known to themselves, tried to have Bailey put away on. That DPP report it seems is all that is keeping Bailey from swinging off crooked French gallows these days, inspite of our minister for justices desire to facilitate them in the time honoured Irish Establishment tradition of shipping our dirty washing off abroad to be cleansed.
Could the DPP not please now go further and use their office to try Marie Farrell for perjury ,the evidence for which has been laid bare in court during the libel case for all to see. Then we will all be a bit wiser as to who most likely didn’t kill Sophie Tuscon Du Plantier and maybe even a little closer to finding out who did.
The syndicatedanarchy document is compehensive and interesting. It presents a case for prosecuting bent cops who doctored 'evidence' to try and get Ian Bailey. It highlights individuals in Schull and surrounding countryside who were put under pressure. It highlights conflicting evidence. It indicates that the gardai were unable to mount a case against Bailey and subjected him and his partner to cruel and slanderous treatment. I might say there is a case for a tribunal of enquiry, except that in the past thirty years we've had too many long-drawn-out and costly tribunals that benefited mainly members of the legal profession.
Make no mistake. This crime was committed by a psychopath. Someone who fantasized about brutally murdering a woman. Someone who had wanted to do this for years. Someone who had been watching Sophie for a while and who could see she was the perfect target due to living alone, in a place where her screams could not be heard. Someone who was well educated on how a crime scene works, making sure no evidence would be left.
It's absurd that Gardai are covering it up to protect a mate. There's not a man on this earth who will protect their mate if they committed a crime of this level of brutality.
If the Gardai were trying to get people to make false statements to frame Bailey, then would that not suggest they were certain who did it but didn't have enough evidence to see justice getting done?
