Squat eviction threat

category dublin | rights, freedoms and repression | news report author Tuesday March 30, 2004 16:20author by curio Report this post to the editors

part II

Not sure of the exact details but this morning at about 11am there were four cops at the Leeson st. squat. Seemingly they attempted to break down the front door, something completely out of the ordinary seeing as (a) it's a civil matter and the cops had already stated that they werent going to get involved and (b) its a listed building they they would have had to get permission to damage. Didnt see any people from the council but the cops were talking to two old conservative looking types. They all left pretty soon when people started showing up. Not sure of all the details as I had to leave very quickly.
Whatever the case it certainly doesnt bode well for the squatters legal rights being upheld.

against the Gardai Siochana for breaking the door?

That's just vandalism.

A squatters camera might be a helpful deterent.
Photos of the "guardians of the peace" kicking in doors...

My bet is that they were trying to do a general search inside and would have just used the lame excuse of eviction to try and get in.

author by squatting is illegalpublication date Tue Mar 30, 2004 20:04author address author phone Report this post to the editors

you twerps might as well be told. squatting is illegal. trespass is actually a crime. maybe that's why the gardai called round. about time you crowd stopped wasting their time.

until recently condoms were illegal...doesnt make it right ...twit.

author by another little magpiepublication date Tue Mar 30, 2004 21:29author address author phone Report this post to the editors

It was the council that arrived first at the door, about four or five of them and it was them who were trying to knock the door in.

The Gardai seemed to be working with them. The Gardai spoke to a neighbour and said they just wanted to talk to us...
hmmm

Thanks to everyone who came down today, it was really appreciated

author by Cabhogpublication date Tue Mar 30, 2004 21:36author address author phone Report this post to the editors

Why should a person who has no traditional or ethnic atachment to squatting be allowed to stay in a house for free?

I can see why the travelling community should be free to break the trespass laws, where the council have failed to provide halthing sites.

What i cannot understand is why a person whould be allowed to invade private property and set themselves up as occupiers of that property wihtout the consent, and to the detriment of the owner of that property.

Also, would the muppet who noted that the Guards smashing down a door was criminal damage, would he have a think about it, and tell me whose property were the guradds criminally damaging?

Chances are it was not the property of the squatters, but of the person who owned the property, who in all likely hood informed the gurads of the illegal activity taking place.

eviction imminent...support will be needed (and greatly appreciated)
today, tuesday the 30th of march, at about 11:30 the magpies were rudely disturbed by a loud bashing sound, the ding dong of the door bell, and a few bashes more...there were apparantly 4 or 5 council workers outside, followed shortly by the gardai (another 4/5). When I personally looked out the window, I saw a sergeant (or which ever ones get to put little red strips on their shoulders), a man (i dont remember his details, I was a bit flustered and just out of bed), and a woman who looked remarkably like Anne Robinson, holding a clipboard. they bashed and we braced the door. I looked out for a moment at this point and saw a big guy in a t-shirt, probably the one doing the bashing.
Around this time our neighbour was passing by and asked what they were doing. they said they wanted to talk to us and asked if he was a friend of ours. he said he was and told them he could ring us and see if we would talk to them.
a strange thing happened next...when our friendly neighbour failed to get through to us, he turned to inform our visitors, but alas, they were getting into their respective vehicles and leaving, just as a few more friends and supporters were ariving.
All of this took about ten minutes to unfold and no letter or notice of any kind was given...as, we believe, is due procedure.
and this just in:
we've been in contact with the grapevine (of the reliable variety) and it says they want us out ...and it will be this week...so from all the magpies: please be ready to support us over the next 3 days...so when the day comes we can make as much noise as we can and let as many people as possible know (including media)...

peck their eyes out, kick them up the hole,
deth to the sheriff!

means a fairly important guard (Super or inspector probably). They're obviously taking it seriously.

author by Wot's all this then?publication date Wed Mar 31, 2004 04:57author address author phone Report this post to the editors

Any bets as to which of them it was? Don't they have to repair the damage they're inflicting on the door or can the Gardai just go around and smash stuff? I thought they were only allowed to assault people and that property was sacred. Silly me.

More seriously does anyone who is reading this know anything about eviction law? I'd have presumed some sort of court order/warrant was necessary for the gardai to be involved in an eviction. What, if any, is the legal basis of their involvement here? Or is this just an informal do what those in power tell you a bit like the way they returned 'escaped' women to Magdalene laundaries in the 50's and 60's.

Depends on who owns the land and how long they've been there. If they've been there a few years, maybe they'd have a case, but the new trespass laws, which were aimed primarily against travellers, give the guards the authority to clear property after being asked to do so by a local authority. This referes both to private and public property, no court order is needed

I reckon as part of preparations for Mayday, authorities want to shut the squat.

With the likelihood of this threat,
how about some
Pre-emptive photojournalism?
