Am I reading this wrong? Are the Iraqis really violating the Geneva Convention by televising pictures of PoWs? The Geneva convention says: Art 13. Prisoners of war must at all times be humanely treated. Any unlawful act or omission by the Detaining Power causing death or seriously endangering the health of a prisoner of war in its custody is prohibited, and will be regarded as a serious breach of the present Convention. In particular, no prisoner of war may be subjected to physical mutilation or to medical or scientific experiments of any kind which are not justified by the medical, dental or hospital treatment of the prisoner concerned and carried out in his interest. Likewise, prisoners of war must at all times be protected, particularly against acts of violence or intimidation and against insults and public curiosity. Measures of reprisal against prisoners of war are prohibited. Does Iraq act in violation by showing the TV pictures of the US PoWs? I don't think so: This is not "public curiosity", but news repoarting ... or else the pictures televised/printed of Iraqi PoWs in "Coalition" hands are in flagrant breach od the same convention. A further thought: By showing those guys alive and (moderately) well, Iraqi TV has made it near impossible to harm them - the world knows they were captured alive and will demand to see them home save and sound. Should I ever become a prisoner, I would actually welcome being filmed in custody just to have proof that I was OK ... before whatever happened (fall down step stairs, involuntary but volatile contact of head to radiator, shot in the back ...). OK, it wouldn't save my life, but it would make a damn good explanation exercise for the perps ... Out of this reason alone the "Coalition" should be happy about any televised image of PoWs ... Twisted logic? |

As far as I was aware, the US constitution reserves the right to declare war to the CONGRESS.
It is not a presidential prerogative .....
We all know that Bush is pretty gung-ho about this war but has he actually bothered to get CONGRESS to rubber stamp it .....
Now before we get into discussion about the Geneva Convention answer me this: has the US Congress voted for a war on Iraq ?
I am not aware of any vote in Congress on the matter ........
If not, technically there is no war (from a purely academic legal point of view), or at least no war has been formally declared in accordance with the US Constitution .....
Without a "war", you cannot - legally apeaking -have "prisoners of war" .........
Those evil Iraqis making propaganda out of poor helpless captured GIs ......

in Afghanistan died due to the effects of torture inflicted by US interrogators.
I am sure if you saw the pictures of the bodies you would be 'horrified'

If I had been flown in for a merry jaunt in the desert as a reservist and then realised that the te=reacherous Iraqis are not only actually fighting back, but also killing people sitting fairly near to me, I would also be shit-scared.

Still - you are assuming a breach of the Geneva Convention, but have no proof.
As I said before, these pictures might actually save lives ... I think no PoW ever being filmed/photographed for propaganda purposes was subsequently killed by his captors.
I watched the pictures of the captured soldiers in horror. They were being asked questions for propaganda purposes and this is against the Geneva Convention.
The site of the eyes of one soldier in particular will live with me forever. He was terrified!!! His eyes kept flitting backwards and forwards from the questioner to somebody standing off camera. He was obviously being heavily coerced into answering 'correctly'.
I will take this opportunity to condemn the US double standards on the Geneva Convention and its implementation in the strongest possible terms as well as Iraq's equally blatant contravention.
Were they simply made up?
The Americans are guilty of a gross case of double standards.
They can incarcerate POWs in Guantanamo in pig-pens open to the elements and use sensory deprivation techniques, and can use the Israelis and Pakistanis among others to torture POWs for them at arms length.
So why are they so worried about a few of their people being interviewed on TV?
Its all about control of news-flow and the US are actually disgusted because they were caught completely wrong footed.
