Rossport Five Judgement Deferred

Uncertainty about whether Rossport 5 will be returned to prison

The Rossport Five had their temporary release extended yesterday when judgement was deferred by the president of the High Court, Mr Justice Joseph Finnegan. The judge said he needed more time to consider the weighty legal matters of the case.

The situation seems to be, that since the injunction has been lifted, the men are not in breach of any court order, and therefore there is no reason to punish them. However to allow the five men -who have already spent over ninety days in prison-
to be released unconditionally calls into question the authority of the high court.

Mr Justice Finnegan has therefore reserved judgement for at least two weeks while all the various options are considered. The Rossport five all apologised to the court on September 30th, seemingly to make clear that they respected the judge’s position. No date for the next hearing has been set.
