The berlin call center “Consatis” has been refusing to pay its workers for the last 6 months. Employees are worried: their contracts state if they are not paid within the next 6 months they may not be paid at all.

Consatis owner, Klaus König hit the headlines in 2001, when his company “Modalis” closed down owing tens of thousands of marks to its employees.

Who are Consatis?
Consatis is a call center situated on the Tempelhofer Ufer in Kreuzberg, employing mainly English speaking foreign workers, many of which can not speak German and have only recently moved to this country.

Founded in 2001, Consatis employees receive a new contract every 2-3 months depending on the length of the project they are part of and the descretion of the manager. Their main contractor is the Siemens AG.

History repeating itself?
Consatis owner, Klaus König hit the headlines in 2001, when his company “Modalis” closed down owing tens of thousands of marks to its employees. The simularities between the two companies are distressing Consatis employees.

Not only do contracts at Consatis exclude the payment of social insurance, sickness insurance, sick pay and holiday pay (Sozialversicherung, Krankenversicherung und “Lohn im Krankheitsfall”), they can be terminated on a daily basis.

Importantly, contracts also include a clause denying the employees the right to payment if the company has not paid them within a period of 12 months - so for many (ex)employees, time is simply running out.

We, a growing number of ex- and current Consatis employees are fed up with the empty promises made by the call center manager. Many of us have been forced to take on other jobs or can not pay our rent, others have left Germany altogether, abandoning the hope of ever being paid.

Wie ich mittlerweile von mehreren gehoert haben, hat die verhorige Firma die leute nie bezahlt. lassen wir versuchen jetzt noch etwas zu machen bevor es zu spaet ist. Ich finde es nicht schlimm zu arbeiten aber umsosnt nein dann kann ich schoenere Sache machen. Consatis versucht es ob wir reagieren wenn wir das nicht machen dann wird die Geschichte ausgehen wie bei Modalis - die arbeiter bleiben ohne Geld, die Geschaeftsfuehrer machen ein schoenes Leben und faenge unter einen anderen Name eine neue Firma an und das Spielchen faengt wieder neu an. Also schick alle ein Mail an Consatis und droh mit anklagen

What happened to your e-mail address it no longer works. I worked for these people and got the impression very quickly that they were exploiting. It is a wonder that they can run their business like this and I want to do something about it. Please update your e-mail address so more people can get in touch.

I worked for consatis when they were still in mitte. I received payment after innumerable phone calls (imagine my worry when the phoone number was no longer in service!) over a period of three months. I went to a briefing a few weeks ago in their new call center am Tempelhofer Ufer, but I didn't work for themm again because I didn't see any reason to trust them again ( they said they were "working on the problem of late payment"). Please use extreme caution when working for this company!!!!

Is there still anyone out there waiting for payment ? I am waiting for one final invoice to be paid, which is now 5 months old. This is really starting to annoy me now!

We handled 3 missions at the same time for Consatis, they paid 2 out of 3 down payments and then refused to pay the full of the invoice.
I discovered (too late) that this seems to be a usual practice of this company and his manager. I hired a lawyer. Action is going on.

I have an invoice dated the beginning of December. It is now, umm, June. I feel sick and angry due to the exploitation of this company towards its workers, and indeed many companies who employ travellers and foreign workers. I also feel powerless. I have called and emailed many times asking for the 680 euro payment. I will join forces with anyone else who feels the same to either get the money owed or to put these corrupt, selfish people of Consatis in their rightful place.

I hope some of you are reading this BEFORE getting involved in working with this company. This company exploits new arrivals in Berlin who often have little of no alternatives, however, if you work for them your wasting valuable time which you could use to find a job foe a reasonable company who actually pay you at all and on time. So basically DON'T WORK FOR CONSATIS! and tell your freinds or people you meet who ask about them NOT TO WORK FOR CONSATIS! iI have worked there as have several other's I know but I've also been able to warn several others not to waste thier time. If no-one work's for this company it's will benefit everyone except those who mean to exploit you.

Hi Guys, another story

Long time back when I was working for Consatis, they didnt pay me for a long time. I still worked in the hope that I would get paid. However, I did mention to some colleagues that I find it really upsetting that they dont pay us. One day I came to office and a Manager told me that we need to talk. He told that I was demotivating other employees etc and 'someone' had done something very bad last night...

Guess what this someone did - he shitted yes guys he really shitted and dirtied the new carpets all over the place and then I understood that the manager thought I had done it. Well to be honest I didnt - as I left office the day before, it was ok.

But it did teach them a lesson :::::))))))

After I left, as a student a time came that I had no money to pay my fee. I called and finally somehow reached König. I told him that I would contact Siemens and send email to all Siemens email addresses I could find and told him that I have already been to a lawyer because I might have to discontinue education because of him. He said if you contact Siemens they will take business back and we will go bankrupt and you dont get your money back. I was persistent and did get the money back in a week.

So guys Pressure Pressure and it will work...

Lately I worked for CONSATIS. CONSATIS is crap, rip-off and dubious. I worked quite lately and they keep on lying about payment. All from CONSATIS are in item. I feel completely cheated.

I also worked for the company over Summer 2007 and still haven't been paid. I heard a rumour that as of 4th January, the company went into receivership. No payments will even be discussed until April and there is a real possibility that workers will not get paid.

No one answers their work emails and the phone is always picked up by a technician.

But to make matters worse, it is also rumoured that Klaus is starting a new company. How is it possible that a man can mismanage two companies (Mondalis & Consatis) and still be allowed to form new ones, while many people are left without the money that have earnt.

The best would be for all ex-workers to get together and put pressure on him and see what redress there is under German law. Whether his actions are criminal is not for me to say, but his incompetence has cost lot of people a lot of money and he shouldn't be allowed to repeat his mistakes.

Contact EU labor law officials or your Embassy - they won't be able to get directly involved, but they will recommend lawyers or appropriate action.

Finally bombard Siemens. Tell them to distance theselves from all business with Klaus, as it can't be in their interest to be associated with somone like him. When Docotors Google the company, the first entries they see are complaints about non-payment and bad treatment of staff, not exactly a good business image.

I have learnt that the insolvency company Hauser & Hawelka are dealing with Consatis.

It's not very impressive that we have to find out by emailing between ourselves - can't the company even have the decency to email workers and at least let them know ? The answer is obviously not.

Hi,

I worked for Consatis from March to June last year and have never been paid one cent. Now I have just received an email from their lawyer saying they are insolvent. I think this means they do not have to pay me anything.
Of course, I feel this situation is very unfair, especially since Klaus König has already done this in the past with Modalis. Is there anything I/we can do? Is it possible to organize some sort of legal or publicity campaign against him? Does anyone have contacts to other Consatis freelancers who are in a similar situation? We should all get in touch and organize something together.

I have consulted with a lawyer today regarding what options are available to Consatis freelancers. As I had thought there is practically no chance of getting our money back from the company. However, considering this sort of unfair dealing seems to be the norm for Mr König, it would be nice if we could make things more difficult for him in future. And this we can do !!!

For no cost at all, we can make a complaint to the Polizei. I will explain the details when you contact me. To be successful, we need to be as many as possible. There is strength in numbers and if we act together, the law will take the case more seriously. So please send me an email so we can organize this together, or if you have contacts to other people who worked at Consatis, please forward them to me.

Also: do you know any other websites where I might find ex-Consatis freelancers?

I suggest emailing / phoning the insolvency lawyers.

There is also an EU Labour comission in Brussels that will help with questions. (Google for the address)
Employees are covered by EU law, but as we were freelancers, we need to see where we stand under German law.

Contact your Embassy. Ask them to warn people looking for work.

Write to Tip / Zitty / and especially Exberliner.

Write / Blogg every website, Facebook, chatroom.

Report him to Siemens - write to every address you can find.

These will at least get his name mentioned and talked about.

He must not be allowed to operate again and we must stop him, even if it means we put up flyers and protest at his new building - because we will find out where he's hiding. If he has no staff and Siemens finally realise he's more trouble than he's worth, he won't have a new company.

I would like to offer whatever help I can.

Back story, short:

Worked for Consatis from mid 2005 - early 2006.
I was partially paid but when the total unpaid reached 500 EUR, I stopped working.

Two months later I still had no money, so I had my German girlfriend do some homework. She has a friend that works to collect money from private individuals and he knew all of the correct paperwork to fill out.

She filed all paperwork for me and we in effect "sued" Consatis starting in fall of 2006.
In the spring of 2007 (at least 6 months after the court found in our favor) I received two payments which brought my account up to date. It was over one year from the last day I worked for the company. There were court costs involved in the filing... These costs were also granted to me by the court, but Consatis refused to pay the costs. Thus we re-filed with the court which found in our favor again. The officer in charge of collection for that area of town was somehow not able to work for (I think) two months, and we waited once again for the money which eventually came on 3 August, 2007.

Last week I got a letter from a bankruptcy lawyer for Consatis. It seems that Consatis went bankrupt officially at the end of August 2007 and I now owe that last bit of money (the fees equaling about 140.00 EUR) BACK to the shyster lawyer.

The law states that any money paid OUT within 30 days before the bankruptcy must come BACK to pay for salaries of the workers. But of course you and I know that this money will go to cover lawyer's fees and there is nothing left to pay the workers. Besides, accessories like Manon will be the first to be paid, and others will be left with nothing while this crook continues on with a new business.

We have consulted the "collector" and they say the law is very cut and dried in this instance... that I owe the money back.

Any information have is appreciated.
Do you know if there is a new company?
What Police district / contact do you have, and should I report to the same area?

Personally I feel that ANY company such as SIEMENS contracting with this guy should get LOTS of publicity - and by that I mean BAD publicity - for their trouble. It is obvious that he undercuts other companies that take the extra effort to PAY their employees, and this is how he operates.

Just let me know what I can do to help because I don't want this worthless piece of crap man to do this to any other well-meaning people.
