category national | miscellaneous | news report author Thursday May 16, 2002 13:30author by Philip Thompsonauthor email philleus at hotmail dot comauthor address gate lodge, upper glenageary road, glenagearyauthor phone 01 2369960 Report this post to the editors

I was arrested in the RTS protest for doing a headstand(see article on 7th of May)and i would like to know if anyone has footage or photos taken at the point where i comitted my "crime"(on the junction on Dame street outside Thomas Reids pub)I have blond dreadlocks and was wearing a black jumper with red stripes. It could come in very useful as they are trying to charge me with abusive behaviour which is totally unfounded.

INDYMEDIA are putting together all video footage (and stills) with which we hope to have a public showing (Media, Garda, Leagal Teams etc.)
Details well be posted as soon as they are finalised.
There is a lot of footage, with more turning up all the time, and will take some time to sort through it all.

Have the mainstream media got an invite?

I'd be interested to compare their reports on what they see to what they actually see.

I have spent a couple of hours this morning going through my official complaint in Pearse Street Guarda Station with a Detective Sergeant Peter O'Boyle. He was from a different Guarda station and seemed very sincere and took a long time writing my complaint out carefully and in detail. I complained originally at the official Guarda Complaints Board in the Irish Life Centre and this was the follow up by the Guardi in the official investigation.
The reason I am telling you this is one thing the D/Sgt explained is the photos posted on here are not sufficient in the way of evidence for court purposes; those of you who have photos and video evidence really need to take it (or a copy of it) and hand it over as evidence to someone like DS O'Boyle so it can be used for the investigations.
If this doesn't happen then more than likely that one Guardi in the video on telly will be scapegoated and the other offenders will go free because many people like me have complained to the Guardi but were lacking ID No's (suprise suprise) and found it very hard to identify specific guardi with only deep but frantic recollections of a very distressing situation. The videos and photos are evidence in themselves but more than that they can be used by the investigators in interviews to show people (like myself) so that positive IDs can be made of the monsters.
PLEASE TAKE YOUR EVIDENCE TO THE INVESTIGATORS. Its to high profile now for it to "go missing" and if the DS I spoke to this morning is anything to go by I think these guys are serious about doing their job.
If anyone wants a contact number for O'Boyle I have one.
Peace, Ben.

At least until your lawyer advises you to. Also the legal advice that I have heard is to refrain from making complaints to the gardai. People who make complaints and who look like having a good case for a civil action often get given extra criminal charges in order to discredit them in advance of the civil case. The gardai have the freedom to add extra charges to cases where they see fit due to evidence from their 'investigations' (like their investigations into the police complaints book). Overall, I'd say that people with video evidence should concentrate on getting it to indymedia, if the filth want it they can always get a court order.

I think that it is possible that the above poster is a f**king pig. So be careful with advice that you get on the newswire and always seek legal advice first.

Don't hand in footage without a court order, if you have footage contact Indymedia and we can advise You. Don't hand in footage and don't speak to the Gardaí without first consulting a soliciter, pay attention to what Oly said, the complaints aren't confidential, they can be used to twist and change any civil action you make, and Pay Stone has made it abundently clear that anyone who complains to the Gardaí complaints board is a "subversive" and "a time waster". So you can see how seriously you'll be taken.

Any photo or video evidence must be submitted in court with the videographer or photographer. But the evidence is valid and doesn't need to be submitted straight away and the evidence given to the complaints board could be used to subvert or discredit your case.

Play smart, they'll try and damage control this, dismiss this and ignore it, they've made the rules but you can play this game better than them.
