The Judiciary - An Ordinary Person's Perspective

category dublin | crime and justice | opinion/analysis author Saturday June 08, 2013 21:57author by CarolynALambertauthor email CarolynALambert at hotmail dot com Report this post to the editors

A memoir based in Dublin, Ireland.

This is a memoir which follows the author as she is subjected ("allegedly") to a constructive dismissal by one of Ireland's largest law firms. She takes a case in the Employment Appeals Tribunal, and questions their impartiality as she gives an account of the report that issues following the hearing and which, she opines, goes against the evidence and information which the Tribunal examined during the three day hearing.

She applies to the Legal Aid Board in Dublin to seek their assistance to take the case to appeal in the Four Courts in Dublin. When assistance is refused, she self-represents in the appeal against the Firm. During the preparation for the hearing, the author sends a summons to the Chairperson of the EAT to make her accountable for the issues which arose in the Determination. The author publishes the correspondence between herself and the Chief State Solicitor's office in Dublin, when he sought to have the summons struck off in order to protect the Chairperson from accountability.

She explains the failures of the system and describes how, on her battle to seek justice, she is subjected to a procedure which, she believes, has been designed to deter people from self-representing in the courts. The author's story questions the impartiality of the Judiciary and brings into question the self-regulation which is granted to them under the Constitution.
